ApplyStorm Terms of Service

These Terms of Service ("Terms") govern your access to and use of ApplyStorm (the "Service"), operated by ZTechEngineering LLC, a Maryland limited liability company operating ApplyStorm at applystorm.net ("we," "us," or "our"). By accessing or using the Service at applystorm.net or any related domains, you ("you" or "User") agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Description of Service

ApplyStorm is a software-as-a-service platform that assists Users with job application activities, including but not limited to: job discovery, application form analysis, resume tailoring, and submission automation. The Service is provided on an "as-is" basis subject to the terms below.

2. Eligibility

You must be at least 18 years of age and capable of entering into a binding contract under the laws of your jurisdiction. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration

To use the Service, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.

4. Subscription Plans and Billing

4.1 Plans

We offer a free tier and paid subscription tiers as described at applystorm.net/pricing. Plan features and pricing may change with prior notice to existing subscribers.

4.2 Billing

Paid subscriptions are billed monthly in advance via Stripe, our third-party payment processor. By subscribing, you authorize us to charge your designated payment method for the applicable subscription fee plus any applicable taxes.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period unless otherwise stated.

4.4 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

4.5 Refunds

Refunds are governed by our Refund Policy, available at applystorm.net/legal/refunds.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law
  • Submit false, misleading, or fraudulent information through the Service
  • Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure
  • Use the Service to send spam, harvest data, or engage in abusive behavior toward employers or job posting platforms
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Resell, sublicense, or commercially exploit the Service without our written permission
  • Use the Service to violate the terms of service of any third-party platform (including but not limited to LinkedIn, Indeed, or applicant tracking systems)

6. Your Content

You retain ownership of any content you submit to the Service, including resumes, cover letters, and profile information ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and transmit your User Content solely as necessary to provide the Service.

You represent that you have all necessary rights to your User Content and that your User Content does not infringe on any third party's rights.

7. Service Availability

We strive to maintain high Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors outside our control. We are not liable for downtime, data loss, or interruptions to the Service.

8. Third-Party Services

The Service integrates with third-party platforms and services, including but not limited to job boards, applicant tracking systems, email providers, and payment processors. Your use of third-party services is governed by their respective terms, and we are not responsible for their availability, accuracy, or content.

9. Termination

9.1 By You

You may terminate your account at any time through your account settings or by contacting us.

9.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms, fraudulent or abusive behavior, or non-payment.

9.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, and limitations of liability) shall survive.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL RESULT IN JOB INTERVIEWS, OFFERS, OR EMPLOYMENT. JOB APPLICATION OUTCOMES DEPEND ON FACTORS OUTSIDE OUR CONTROL.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZTECHENGINEERING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR EMPLOYMENT OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

12. Indemnification

You agree to indemnify and hold harmless ZTechEngineering LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maryland, and you consent to the jurisdiction of such courts.

14. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
